"The Fairbanks North Star Borough recently sued the Army Corps of Engineers for asserting jurisdiction over borough lots underlain with 20 inches of permafrost; the Corps considered them "waters of the United States," meriting regulation. The Fairbanks lawsuit is an early test of the corps' interpretation of the CWA following the important June 19, 2006, U.S. Supreme Court decision in Rapanos v. United States."
